There are a few options to terminate mandatory lifetime sex offender registration.
CERTIFICATE OF REHABILITATION
A Certificate of Rehabilitation will relieve certain sex offenders from having to continue register pursuant to PC 290. A certificate of rehabilitation is issued by the Superior Court of California in the county in which you reside and is a strong statement from the California trial court that you are a rehabilitated person who is honest and law-abiding, obeying and conforming to the laws of the land.
For offenses that do not fall under the purview of the Certficate of Rehabilitation, courts have found that some of those offenses mandatory lifetime registration were unconstitutional. Although the courts have found that those convicted of the offenses below should not be subjected to the lifetime mandatory registration requirement, the Hofsheier appeal allows an individual to demonstrate to the court that they should not fall under the under its discretionary authority to impose the registration requirement under Penal Code Section 290.006.
PC section 290.006 allows the trial court to have the discretion to order lifetime registration as to any offender even if the defendant was not convicted of a sexual offense if the court finds that “the person committed the offense as a result of sexual compulsion or for purposes of sexual gratification.” Contact the Law Firm of Higbee & Associates to have an experienced attorney discuss your options at terminating your registration requirement.
